1. O Supremo Tribunal Federal declarou a inconstitucionalidade da inclusão do ICMS na base de cálculo do PIS e da COFINS, na sessão de julgamento de 15 de
março de 2017 (RE 574706, Relator(a): Min. CÁRMEN LÚCIA, Tribunal Pleno, julgado em 15/03/2017, ACÓRDÃO ELETRÔNICO DJe-223 DIVULG 29-09-2017
PUBLIC 02-10-2017).
2. A eficácia obstativa - não meramente suspensiva - decorre da decisão do Supremo Tribunal Federal.
3. A suspensão da exigibilidade tributária, no caso concreto, é cabível.
4. Agravo de instrumento provido.
